These Terms of Service govern your use of the Play It Again website, mobile app, TestFlight beta, and related services. By accessing or using Play It Again, you agree to these Terms. If you do not agree, please do not use the service.
Who may use Play It Again
You must be at least 18 years old and able to enter into a binding agreement to use Play It Again. The service is intended for adults creating films for family and friends. Children may appear in media only with the involvement and permission of a parent or legal guardian.
The service
Play It Again helps you create short films from photos, videos, audio, names, story choices, and other material you provide. Features, processing times, output formats, and availability may change as the service develops. Beta features may be incomplete, contain errors, or change without notice.
Your content
You keep ownership of the content you upload. You grant Play It Again a limited, worldwide, non-exclusive license to host, copy, process, modify, combine, and display that content only as reasonably necessary to operate the service, create and deliver your film, provide support, and maintain security.
You represent that you have all rights and permissions needed for the content you submit, including permission from people shown or heard in it. You are responsible for deciding who receives a finished film and for obtaining any consent required for children, private locations, music, or other protected material.
Acceptable use
You may not use Play It Again to:
- Break the law or violate another person’s rights.
- Upload content that is abusive, exploitative, deceptive, defamatory, or unlawfully invasive of privacy.
- Exploit or endanger a child or animal.
- Transmit malware, interfere with the service, bypass security, or attempt unauthorized access.
- Reverse engineer, scrape, resell, or misuse the service except where the law expressly permits it.
App access and purchases
Access through Apple TestFlight is also subject to Apple’s terms. If paid features or subscriptions are introduced, the price and applicable payment terms will be shown before purchase. Unless stated otherwise, taxes and third-party charges are your responsibility.
Play It Again materials
The service, including its software, design, branding, templates, narration, music, graphics, and other materials provided by us, is owned by Play It Again or its licensors and is protected by intellectual-property laws. These Terms give you a personal, limited, non-transferable right to use the service; they do not transfer ownership of our materials to you.
Third-party services
Play It Again may rely on or link to third-party services, including Apple TestFlight. Those services are governed by their own terms and privacy practices. We are not responsible for third-party services that we do not control.
Suspension and termination
You may stop using Play It Again at any time. We may suspend or terminate access when reasonably necessary to protect users, comply with law, prevent misuse, or address a material violation of these Terms. Provisions that by their nature should continue after termination will remain in effect.
Disclaimers
To the fullest extent permitted by law, Play It Again is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, permanent storage, or that every generated film will meet your expectations. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
Limitation of liability
To the fullest extent permitted by law, Play It Again and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from your use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid to Play It Again for the service during the twelve months before the event giving rise to the claim, or $100 if you paid nothing. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Indemnity
To the extent permitted by law, you agree to defend and indemnify Play It Again and its team against claims, losses, and reasonable costs arising from your content, your misuse of the service, or your violation of these Terms or another person’s rights.
Changes to the service or Terms
We may update the service and these Terms from time to time. We will post revised Terms here and update the date above. If a change is material, we will provide reasonable notice when appropriate. Your continued use after the revised Terms take effect means you accept them.
General terms
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of assets. These Terms and our Privacy Policy are the entire agreement between you and Play It Again concerning the service.
